Mijas Bylaw Article 89. Presence of Animals on Public Streets

1. Animals are prohibited from circulating on public streets unless accompanied by trained personnel or someone who supervises them, provided with a collar and kept on a chain or leash. They must be muzzled when they are considered potentially dangerous or the animal’s temperament so advises, and under the responsibility of the owner.

Dogs may be run loose in the areas and places designated by the City Council; in public parks and gardens that do not have a fenced-off area, they may be run loose, under the close supervision of their caretaker, from 7:00 p.m. to 9:00 a.m. during the fall and winter seasons, and from 10:00 p.m. to 8:00 a.m. during the spring and summer seasons.

2. Dogs are prohibited from being in sandpits and children’s play areas. 3. The transport of dogs on public transport is prohibited, with the exception of those accompanying blind people.

4. In all cases, the animal’s handler is required to have means to collect and remove excrement immediately and hygienically. The handler must clean the affected area of ​​the road or public places, depositing the excrement in a plastic bag in garbage containers or in specific containers installed by municipal services.

5. All owners or keeper of dogs (Canis familiaris) are required to identify them according to the appropriate municipal records within three months of their birth or one month after their acquisition. Owners are also required to report the animal’s deregistration, in the event of death, loss, or theft, to the City Hall where the dog is registered.

6. The continued presence of dogs on apartment terraces and in vacant lots is prohibited. In these cases, owners may be fined if the dog barks at night.

7. Violations of these behaviors constitute a minor offense.

Feeding of animals

We like to remind our residents of what rules/laws apply in Mijas.

Article 86. Animals

1. It is prohibited to fish, hunt or mistreat by any means fish, birds or other animals that are found in the gardens, parks or facilities referred to in this ordinance, without prejudice to the application of the sectorial regulations on hunting and fishing.

2. For reasons of public health and environmental protection, the supply of food to stray or abandoned animals and any other animals is prohibited in public spaces, as well as in any other places, such as plots of land or buildings, when in the latter case, it could turn them into sources of unhealthiness or generate dirt or discomfort.

However, the following are excepted:

a. Feeders or caretakers of colony control, duly accredited by the City Council, whose activity will always be subject to the absence of disturbance to third parties or dirt and deterioration of the space and urban furniture, if not, it will be prohibited.

b. In those parks, green spaces and enabled sites, also subject to the absence of disturbance to third parties or dirt and deterioration of the space and urban furniture, since otherwise it will be prohibited.

c. Guide dogs are also excepted.

3. The violation of this prohibition constitutes a minor infraction. Against this agreement, in accordance with article 19 of the Revised Text of the Law Regulating Local Finance, approved by Royal Legislative Decree 2/2004, of March 5, the interested parties may file an administrative appeal, within a period of two months from the day following the publication of this announcement in the Official Gazette of the Province, before the High Court of Justice of Andalusia.

Rules and Regulations

The Mancomunidad does not have any specific Rules and Regulations. The Mancomunidad is covered by the Mijas Town Council Bylaw For Security And Citizen Coexistence.

Especially Article 100. – Instrument and musical equipment noise, is of particular interest in regards to Citizen Coexistence:

  1. The conduct of citizens in the public road, areas of public gatherings and in public
    or private service vehicles must remain within the limits of good citizen coexistence. Especially, and unless with municipal authorisation, it is forbidden to disturb the
    peace and quiet of the neighbours and pedestrians by:
    a) The operating of television, radio, musical or other audio devices.
    b) Sing, shout or any other irritating act.
    c) To transcend the musical ambience to the exterior of a property.
    d) To use megaphones which generate discomfort to citizens.
    e) To perform any activity or construction noise that generates disturbance.

The nocturnal rest period is understood as being from 10 p.m. till 8 a.m. the following
morning, except on Saturdays and the eve before holidays which will be from 12
p.m. till 8 a.m.
the next morning. Likewise, works and other activities that may
disturb the relaxation of the neighbours and that take place in the municipality must
respect the rest period, unless they have municipal authorisation.

Tightened water restrictions in Mijas

A ban on using drinking water to irrigate golf courses, fill pools and for decorative fountains has now also been introduced in the municipality of Mijas.


The decision on tighter restrictions has been taken by the municipal management of Mijas in order to comply with the regional regulations, which require a reduced consumption of drinking water in the area of at least ten percent. This is to ensure access to drinking water on the Costa del Sol at a time when the reservoirs hold significantly less water than normal. This is written by the newspaper La Opinión de Málaga.

The new ordinance in Mijas prohibits the use of potable water for the irrigation of golf courses as well as for filling private pools (with the exception of minimal refilling of already filled pools, to compensate for gradual water level loss needed for the filtration process). The ban also applies to the washing of cars other than at authorized facilities, the use of decorative fountains that lack closed water systems, public showers and fountains, and all other consumption that is not found to be absolutely necessary.

The regulation further limits the frequency and intensity of irrigation in gardens, plantations, parks and green areas, both public and private, as well as the cleaning of streets, pavements, facades and other surfaces with drinking water. The municipality asks the residents for cooperation for a responsible and efficient use of the drinking water, to control possible leaks and to introduce measures that reduce the consumption of drinking water privately. They also announce that the restrictions may be extended depending on how the drought situation develops.
